Abstract
A Reconstruction of Religious Freedom & Equality: Gay Lesbian
& De Facto Rights & the Religious School in Queensland
The article considers the impact that the changes made to anti-discrimination
laws in Queensland in 2002 have had on religious freedom and equality in the
State. While concluding that the consequent strengthening of religious equality
is to be welcomed, the author argues that the narrowing of the freedoms of religious
schools that has resulted is illegitimate. The amendments - that the Government
claims were agreed to by church, gay and lesbian groups - legislate a 'don't
ask, don't tell' policy that extends the public accountability of religious
schools beyond the limits of religious freedoms enjoyed by most other Australians.
